Scottish landlord law is among the most comprehensive in the UK. If you own a rental property in Edinburgh, the Borders or anywhere in Scotland, there are several safety certificates you are legally required to hold — and the penalties for non-compliance are significant. Here's the complete picture.

The Three Core Certificates

EICR — Electrical Installation Condition Report
Required every 5 years

A full electrical inspection and test of the property's wiring, consumer unit, sockets and earthing. Must be carried out by a qualified electrician holding the 2391 qualification. A copy must be provided to tenants within 28 days and to the local authority on request.

Gas Safety Certificate (CP12)
Required annually (if gas appliances present)

If your rental property has any gas appliances — boiler, gas fire, gas hob — you must have an annual gas safety check carried out by a Gas Safe registered engineer. The certificate (CP12) must be provided to tenants within 28 days. Note: Spotlight Electrical handles the electrical side; you'll need a Gas Safe engineer for this certificate.

Smoke & Heat Alarm Compliance
Ongoing — must be verified at start of each tenancy

Since February 2022, all Scottish homes must have interlinked smoke alarms in the living room and all circulation spaces, a heat alarm in the kitchen, and CO detectors where carbon-fuelled appliances are present. Landlords must verify these are in working order at the start of each tenancy.

Penalties for Non-Compliance

Repairing Standard Enforcement Order
The First-tier Tribunal can issue an enforcement order requiring you to carry out the work within a set timeframe.
Rent Relief Order
If you fail to comply with an enforcement order, the Tribunal can reduce the rent payable by up to 90% until the work is completed.
Landlord Registration Suspension
Persistent non-compliance can result in suspension or removal from the Scottish Landlord Register, making it illegal to let the property.
Insurance Invalidation
Many landlord insurance policies require current safety certificates. Non-compliance can invalidate your policy entirely.
